Terms of Service

These Terms govern the use of this online store and the purchase of products through it.

By placing an order, the customer confirms that they have read and agree to the applicable terms and conditions, provided these have been properly made available to them before the contract is concluded. This does not affect their statutory rights.

Products

Each product is carefully described and illustrated. However, colours may vary slightly depending on the settings of the customer's device. This does not affect any statutory rights if the delivered product does not conform to the agreed specifications.

Orders and Payment

Orders placed through the online store are concluded in accordance with the terms presented during checkout and upon order confirmation.

Purchases of original paintings, artwork reservations, and custom commissions may also be arranged individually in writing, for example by email. In such cases, deposit amounts, payment deadlines, and the point at which the agreement becomes binding are confirmed individually.

Payments are processed through the available secure payment methods, such as credit or debit cards and PayPal, or through another method agreed upon in advance.

Original Paintings and Commissions

Purchases of original paintings, artwork reservations, and custom commissions are also subject to the separate Original Paintings & Commission Terms, provided these have been made available to the customer before the contract is concluded and have become part of the agreement.

Individually agreed terms may supplement or modify these provisions to the extent permitted by applicable law.

Shipping

Production and shipping arrangements vary depending on the type of product. Open Edition Prints are produced and shipped by an external printing company, while Limited Edition Prints are shipped directly from the Czech Republic. Original paintings and commissioned artworks are shipped according to individual arrangements.

Delivery times may vary depending on the destination country and the selected shipping method.

International orders may be subject to customs duties, import taxes, or other charges. Unless otherwise stated and where permitted by applicable law, these charges are the responsibility of the customer.

Delays caused by shipping carriers, customs procedures, or other circumstances beyond the seller's reasonable control may affect estimated delivery times. Any delivery issues will be handled in accordance with applicable law and the customer's statutory rights.

Returns and Complaints

The conditions governing withdrawal from the contract, returns, and complaints are set out in the separate Refund Policy.

Individually arranged commissions may also be subject to the provisions of the Original Paintings & Commission Terms.

Nothing in these Terms limits or excludes any statutory customer rights that cannot lawfully be waived or restricted.

Intellectual Property

All original artworks, images, and other protected content on this website are protected by applicable intellectual property laws.

This content may not be copied, reproduced, or commercially exploited without the permission of the relevant rights holder, unless such use is permitted by law or an applicable licence.

Purchasing a physical artwork does not automatically transfer copyright or grant the right to commercially reproduce the artwork. Any applicable licence is governed by the individual agreement, the purpose of the commission, and applicable law.

Limitation of Liability

The seller is not liable for circumstances for which they bear no responsibility under applicable law.

Nothing in these Terms excludes or limits the seller's liability or any statutory consumer rights where such exclusion or limitation is prohibited by law.

Governing Law

These Terms and contracts concluded through this online store are governed by the laws of the Czech Republic.

If the customer is a consumer habitually residing outside the Czech Republic, this choice of law does not deprive them of the protection afforded by the mandatory provisions of the laws of their country of habitual residence, where such protection applies under the relevant rules of private international law.

Nothing in these Terms affects statutory consumer rights that cannot lawfully be waived or restricted.

Changes to These Terms

I reserve the right to update these Terms from time to time. The current version will always be available on this page.

Changes to these Terms will not apply retroactively to contracts already concluded without an appropriate legal basis or agreement between the parties.
